Keeping up with its trend, Cash Money Records has landed itself in the middle of yet another lawsuit. This one though involvesYoung Money rapper Drake. According to Playboy Enterprises and Playboy Music, Inc. the Canadian lyricist sampled one of their songs on his hit track Best I Ever Had.
In the lawsuit that was filed at the U.S. District Court in downtown Los Angeles on Friday afternoon (June 25), Playboy claims that Drake’s single uses parts of the track Fallin’ In Love by Hamilton, Joe Frank and Dennison/Reynolds, which they own the copyright for. The companies also state that either the rapper and/or his record label “knew or should have reasonably known, that the sound recording was protected by copyright.”
They are asking for the court to issue an injunction that would prevent the defendants from selling and distributing the song and place a halt to profits. Playboy also wants an accounting of all the profits, gains and advantages rendered from the song and they want the rapper to pay the associated court costs and attorneys’ fees.
In related news, New York DJ Absolut filed a lawsuit against rapper Kia Shine, who co-wrote Best I Ever Had. According to the radio personality, he contributed to the production ofDrake’s song and was entitled to 20% of all proceeds, but received none.
